Privacy Policy

1. Introduction

Matthew Mangold Coaching, a service of Nth PWR Enterprises LLC ("Company," "we," "us," or "our") operates the website located at matthewmangold.com (the "Site"). This Privacy Policy describes how the Company collects, uses, stores, and protects personal information when you visit the Site, submit information through forms, book services, make payments, or otherwise interact with the Company.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. This Privacy Policy is effective as of September 2, 2026.

2. Information We Collect

The Company collects two categories of information:

(a) Information You Provide Directly

Contact Form Submissions: When you submit a contact form on the Site, we collect your name, email address, phone number, company name, and the content of your message.

Calculator Results Requests: When you ask for your results from the Constraint Calculator, we collect your name, email address, mobile phone number, company name, your calculator answers, and the result shown to you. When you ask for your results from the Tech Stack Audit, we collect your first name, email address, and your score. If you check the optional text message box, we also record that you agreed, the wording you agreed to, and when.

Scheduling Information: When you book the Profit Diagnostic through the Site, we collect your name, email address, and scheduling preferences through our scheduling provider, TidyCal.

Payment Information: When you purchase services through the Site, our payment processors collect your payment card information, billing address, and transaction details. The Company does not directly store credit card numbers.

Communications: When you communicate with the Company by email or other means, we collect the content of those communications, including any personal information you choose to provide.

(b) Information Collected Automatically

When you visit the Site, certain information is collected automatically through Cloudflare, our hosting provider, Cloudflare Web Analytics, and Google Analytics, our analytics provider. The Site's text fonts load from Google Fonts, so Google receives your IP address and browser details when a page loads. This information includes your IP address, browser type, device type, operating system, pages visited on the Site, referring URLs, and the time and date of your visits. This data is collected to operate, maintain, and improve the Site.

3. How We Use Your Information

The Company uses the information it collects for the following purposes:

• To respond to your inquiries and communicate with you regarding your requests.
• To deliver advisory services that you have purchased or requested.
• To process payments for services.
• To send transactional communications, including form confirmations and service-related correspondence.
• To improve the Site, its content, and the user experience.
• To protect against fraud, unauthorized access, and bot activity.
• To comply with applicable legal obligations, including tax and accounting requirements.

4. Third-Party Service Providers

The Company uses the following third-party service providers to operate the Site and deliver services. Each provider processes personal information only as necessary to perform its designated function. Each provider maintains its own privacy policy governing the data it collects and processes.

Cloudflare: Cloudflare provides website hosting (Cloudflare Pages), DNS, and content delivery network (CDN) services for the Site. Cloudflare collects technical data including IP addresses, browser type, device information, and pages visited. Cloudflare Turnstile is used for bot protection on forms and collects interaction data to verify that visitors are human.

Google Analytics: Google Analytics collects usage data about how visitors interact with the Site, including pages visited, session duration, referring URLs, and approximate location derived from IP address. This data helps the Company understand traffic patterns and improve the Site.

Cloudflare KV: Contact form submissions sent through the Site's own form handler are stored in Cloudflare Workers KV, a data store in the Company's Cloudflare account.

Supabase: A backup copy of contact form submissions may also be stored in a Supabase database when that backup is switched on. Supabase processes the name, email address, phone number, company name, and message content.

Google Sheets: Results requests from the Constraint Calculator and the Tech Stack Audit are stored in a Google Sheet in the Company's Google account, sent there through a Google Apps Script.

TidyCal: TidyCal is an embedded scheduling tool used for booking the Profit Diagnostic. When you book, TidyCal collects your name, email address, scheduling preferences, and payment information for the booking.

Stripe: Stripe processes payments for advisory services offered by the Company. Stripe collects payment card information, billing address, and transaction details. The Company does not store credit card numbers.

Resend: Resend is an email delivery service used to send transactional emails, including form confirmations and service-related communications. Resend processes email addresses and message content.

Anthropic Claude: Anthropic Claude is an artificial intelligence platform used in analysis, content creation, and deliverable preparation. Client information shared during advisory engagements may be processed through this platform. Additional details are provided in Section 5.

The Company does not sell, rent, or trade your personal information to third parties.

5. Artificial Intelligence Disclosure

The Company uses artificial intelligence tools, currently Anthropic Claude, in content creation, analysis, and deliverable preparation as part of its advisory services. Client data shared during advisory engagements may be processed through AI platforms in the course of preparing analyses and deliverables.

All AI-generated outputs are reviewed and approved by the Company before delivery to clients. The Company selects AI providers based on their data handling practices, security measures, and privacy policies. The Company does not use AI tools to make automated decisions about clients without human review.

6. Tracking Technologies

The Site uses Google Analytics to collect usage data about how visitors interact with the Site. This data helps the Company understand traffic patterns and improve the Site experience. Google Analytics uses cookies to distinguish visitors and sessions.

Cloudflare Turnstile is used on forms for bot protection. Turnstile uses interaction analysis to verify that visitors are human. Turnstile does not use traditional tracking cookies.

Google Analytics settings: the Site uses basic Google Analytics measurement only. Google signals, Google Analytics advertising features, and user-provided data collection are turned off, and the Site runs no ads, retargeting pixels, or advertising networks. Google Analytics sets first-party cookies named _ga and _ga_ followed by an ID, kept for about 13 months, to count visits and sessions. Granular location and device data collection is on, so Google Analytics records approximate location, such as city, and device details, such as browser, operating system, and screen size. When a lead form is submitted, the Site records that a form was sent and which form, never your name, email address, or phone number.

How to opt out: you can stop Google Analytics on every site you visit with the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

Cloudflare Web Analytics measures page visits without cookies.

Do Not Track: the Site does not respond to browser Do Not Track signals.

6a. Text Messages

The Company sends marketing text messages only to people who checked the optional text message box. Agreeing is never a condition of buying anything. Message frequency varies, and message and data rates may apply. Reply STOP to stop or HELP for help. The Company does not share mobile numbers with anyone for their own marketing.

7. Data Retention

The Company retains personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, subject to the following:

Contact form submissions are retained for the duration of the business relationship and for a reasonable period afterward to support follow-up communications and business records.

Payment records and transaction data are retained as required by applicable tax, accounting, and financial recordkeeping laws.

Analytics data is retained in accordance with the applicable provider's standard data retention policies.

Communications and correspondence are retained for as long as necessary to support the business relationship and comply with legal obligations.

You may request deletion of your personal information at any time by contacting the Company at legal@matthewmangold.com. The Company will respond to deletion requests within a reasonable timeframe, subject to any legal obligations that require the Company to retain certain records.

8. Your Privacy Rights

Depending on where you reside, you may have certain rights regarding your personal information.

General Rights: You may request access to the personal information the Company holds about you. You may request correction of inaccurate personal information. You may request deletion of your personal information, subject to applicable legal exceptions. Where applicable, you may request portability of your personal information in a commonly used, machine-readable format.

California Residents (CCPA): If you are a California resident, the California Consumer Privacy Act ("CCPA") provides you with the following rights:

• Right to Know: You have the right to know what categories and specific pieces of personal information the Company has collected about you.
• Right to Delete: You have the right to request that the Company delete personal information it has collected from you, subject to certain exceptions.
• Right to Opt Out of Sale: The Company does not sell personal information. Because no sale of personal information occurs, no opt-out mechanism is required.
• Right to Non-Discrimination: The Company will not discriminate against you for exercising any of your privacy rights.

To exercise any of these rights, please contact the Company at legal@matthewmangold.com. The Company will verify your identity before processing your request and will respond within the timeframes required by applicable law.

Other State Residents: If your state of residence provides additional privacy rights under applicable law, you may exercise those rights by contacting the Company at legal@matthewmangold.com.

9. Do Not Sell My Personal Information

The Company does not sell personal information as defined under the California Consumer Privacy Act or any other applicable state privacy law. The Company does not disclose personal information to third parties in exchange for monetary or other valuable consideration.

Because no sale of personal information occurs, no opt-out mechanism is required. However, the Company will honor any such request it receives. To submit a request, contact the Company at legal@matthewmangold.com.

10. Children's Privacy

The Site is not directed to individuals under the age of eighteen (18). The Company does not knowingly collect personal information from anyone under the age of eighteen. If the Company becomes aware that it has collected personal information from a person under eighteen, the Company will take steps to delete that information promptly.

If you are a parent or guardian and believe that your child has provided personal information to the Company, please contact the Company at legal@matthewmangold.com so that the Company can take appropriate action.

11. Data Security

The Company uses commercially reasonable measures to protect the personal information it collects and stores. These measures include secure website hosting through Cloudflare, encrypted payment processing, and access controls on stored data.

No method of electronic storage or transmission over the internet is completely secure. While the Company strives to protect your personal information, it cannot guarantee absolute security. You acknowledge that you provide personal information at your own risk.

If the Company becomes aware of a security breach that affects your personal information, the Company will notify you in accordance with applicable law.

12. Changes to This Privacy Policy

The Company may update this Privacy Policy at any time. Changes are effective upon posting to the Site. The date at the top of this document reflects the most recent revision.

The Company encourages you to review this Privacy Policy periodically to stay informed about how the Company collects, uses, and protects your personal information. Your continued use of the Site after any changes to this Privacy Policy constitutes your acceptance of the revised policy.
